1.1 The below Terms & Conditions are a legal binding agreement between you as the Client, and Rockmybaby® as the agency. This is for Rockmybaby® Group.
1.2 Completion of the following – registering on Rockmybaby® website, completion of the Babysitter Request Form, Job Summary Form (this form is completed on arrival of babysitter), or the Nanny Request form - is instant acceptance of the agency Terms & Conditions.
1.3 The word “Rockmybaby®” refers to Rockmybaby® Nanny & Babysitting Agency (Agency).
1.4 The word “Client” refers to the person/family/employer using Rockmybaby® services.
1.5 The word "Candidate" refers to any person that Rockmybaby® introduces to the Client.
1.6 The word “Nanny” refers to a childcare professional who is registered with Rockmybaby® who may be engaged by a Client in a full time, part time or temporary capacity.
1.7 The Terms & Conditions are the terms of which Rockmybaby® offers the Client access to the services and use of the Rockmybaby® website and agency. By registering with Rockmybaby® the Client agrees to abide by these Terms & Conditions. If the Client does not agree to abide by these Terms & Conditions, then the Client must refrain from using the Rockmybaby® website.
1.8 Posting false, incomplete, inaccurate or illegal information is strictly prohibited and may be punishable by law.
1.9 Unlawful or illegal use of information will be reported to the proper authorities and may be punishable by law.
2.1 Any correspondence or communication, either verbal, written, or via email is confidential and the Client agrees not to disclose this to third parties.
2.2 All babysitting bookings/permanent or temporary nanny placements must be made directly between you (the Client) and Rockmybaby® (the agency).
2.3 No bookings or offers of permanent or temporary employment are to be made directly with the Candidate. Should this obligation be ignored, the Candidate is legally obliged to inform the agency and the relevant fees will be charged to the Client.
2.4 The Client agrees that Rockmybaby® requires our Candidates to be in an occupationally safe environment.
2.5 Where Rockmybaby® (in its absolute discretion) believes that there is sufficient negative feedback, or feedback is of a concerning nature regarding the Client, Rockmybaby® will refrain from referring any Candidates to the Client.
2.6 The Client agrees to pay petrol and parking fees if applicable. Note: current Australian standard rate for petrol reimbursement is 66c/km.
2.7 The Client must not disclose, and always agrees to keep in confidence, the identity of all Candidates referred by Rockmybaby®, along with the contents of any documents/emails forwarded on the Candidate’s behalf. If the Client discloses information about a Candidate to any third parties (i.e. friend, family member or colleague) who acting on that information, subsequently employs/engages any employed or referred Candidate, the Client agrees to pay the applicable agency fee charged by Rockmybaby®.
2.8 Clients are responsible for the continued confidentiality of their login details – in an event of unauthorized use by a third party; the Client account may be deleted.
2.9 Clients agree to immediately notify Rockmybaby® of any unauthorized use of their login or password.
2.10 Clients must ensure that they exit from their account at the end of each session on the Rockmybaby® website. 2.11 Rockmybaby® values transparency and honesty with our clients and candidates regarding Health and Safety. Safe and Healthy Work Environment -The client agrees that they are responsible for the safety and wellbeing of the candidate. As his or her employer they clients agrees to comply with the Health and Safety laws. Provide a clean and hygienic living environment and will provide a safe place of work wherever the applicant may need to work.
3.1 The Client agrees there is a minimum 3 hour booking payable to the Babysitter Candidate.
3.2 The Client agrees to pay the Babysitter Candidate directly at the end of the babysitting booking the agreed regional rate.
4.1 The Client will notify the agency immediately if any extension of any temporary placement occurs and agrees further placement fees will apply.
4.2 The Client agrees to notify the agency immediately if a Candidate has been introduced via a third party (agency, another website, advert etc). Failing to inform the agency will result in full placement fees if the Candidate has been employed by the Client.
4.3 The agency who first introduces the Nanny, via any mediums of communication will be due the placement fees.
4.4 Once the Client offers employment to one of the Rockmybaby® Nanny Candidates – the Client understands a placement fee will apply.
4.5 The Client agrees to enter into an employment contract with the Nanny Candidate and abide by all statutory obligations of employment.
4.6 The Client agrees that they are the employer of the Candidate – not the agency.
4.7 Clients, by engaging the Candidate as an employee, are solely responsible for the following:
4.71 Abiding by all the statutory obligations for employing a Nanny,
4.72 Full time, casual, or part time income tax payments.
4.8 The Client is solely responsible for ensuring that the Candidate is eligible to work in the Client's country, and for obtaining and paying for any relevant work permits/visas/immigration requirements that may be necessary and for arranging any medical examinations or investigations into the medical history and health, or travel insurance where applicable.
4.9 Where the Candidate is required to drive, the Client agrees that they are responsible for ensuring the Nanny has a current and valid driver’s licence suitable for the purpose(s) required by the Client, and is familiar with the Australian road rules, and roads;
4.10 Rockmybaby® cannot be held responsible for the Nanny’s driving skills or lack thereof; and
4.11 The Client is responsible to ensuring any vehicle that the Client wishes the Candidate to drive is fully insured, roadworthy, and has passed the appropriate state vehicle safety inspections. Rockmybaby® cannot be held responsible for any traffic offences, insurance claims, or parking infringements incurred by the Candidate.
5.1 Fees are payable in Australian Dollars.
5.2 All booking fees are non-refundable if the Client cancels a booking.
5.3 All booking fees are payable per day and per booking. If the Client requires two separate bookings for the same day, two booking fees would apply. If any extension of a booking is made, daily agency fees will apply.
5.4 Rockmybaby® holds the right not to dispatch a Candidate if the agency fee has not been received via online booking or internet banking deposited in the Rockmybaby® bank account within 24 hours of the commencement date.
5.5 The Client agrees to pay the regional babysitting rate set by Rockmybaby®

5.6 Rockmybaby® Group reserves the right to increase our agency fees at any time.
6.0 Nanny/temporary placement fees are to be paid prior to the nanny commencing work. Trial periods will be invoiced as per temporary nanny fees.
6.1 The invoice will be sent via email with payment due within five business days, via Client credit card, or otherwise, only by prior arrangement.
6.2 Rockmybaby® holds the right to withhold the start date of the Nanny if the agency fee has not been paid. Overdue accounts will incur a penalty interest of 24% per annum, and if referred to a collection agency, additional costs will be incurred, which is the Client’s responsibility.
6.3 If the candidate’s days of permanent employment or a temporary contract have been extended then the appropriate charges will be invoiced, i.e. positions extended for more than 3 months will be treated as extension to a permanent placement, and subsequently invoiced. Those placements extended for less than three months will incur daily fees, as per Rockmybaby®’ fee schedule, detailed on the Fees page on the website.
6.4 The Client agrees to inform Rockmybaby® agency if a permanent placement or temporary contract requires additional days or extended hours from initial request.
6.5 Rockmybaby® Group reserves the right to increase our agency fees at any time.
6.6 An upfront engagement/search fee applies for temporary and permanent placements in the Sydney location.
7.1 If cancellation of the Babysitter Candidate is made by the Client within 3 hours of the agreed start time, a minimum of 3 hours will be charged to the Client and forwarded onto the Babysitter Candidate.
7.2 If any wedding or event care packages are cancelled within 7 days of start date by the Client, then a 50% charge will occur to the Client.
7.3 Rockmybaby® cannot be held responsible for cancellations or no-shows of a Babysitter Candidate.
8.1 Overdue accounts will incur a penalty interest of 24% per annum, and if referred to a collection agency, additional costs will be incurred, which is the Client’s responsibility.
8.2 If the Client cancels employment of the Nanny before the agreed start date, the agency will charge the Client 50% of the invoiced agency fees, with a minimum of $500 + GST
8.3 If the Candidate cancels employment before the agreed start date, then a full refund will be given, with the first option of Rockmybaby® finding a suitable replacement.
8.4 If a temporary placement is cancelled within 24 hours of start date a total of 50% of total Nanny wage is due to the Nanny Candidate.
8.5 Rockmybaby® reserves the right to cancel immediately any babysitting or nanny services if the Rockmybaby® Candidate has been mistreated, is working in an occupationally unsafe environment, or is harmed in anyway.

9.1 Although Rockmybaby® endeavours to find a Babysitter Candidate on request, we cannot always guarantee this will be possible.
9.2 In the unfortunate circumstance where a Babysitter Candidate cannot be found on the requested date/s, the total booking fee will be credited forward for a future booking, or when requested, a full refund of the Rockmybaby® agency fee will be given.
9.3 This credit/refund policy also applies if the booked Babysitter Candidate cancels or no-shows to the booking and a second Babysitter Candidate cannot be found.
9.4 Although Rockmybaby® has high expectations of our Candidates, and we aim to provide you with exceptional Candidates, there is still no complete guarantee of reliability, honesty, and character of the Candidate provided by the agency. If the Client has any concerns, please contact Rockmybaby® immediately.
10.1 The Guarantee for nanny placements will only be applicable to invoices settled within the 5-day payment period.
10.2 The Agency fees are non-refundable. Should the Nanny Candidate leave the employment within 4 weeks from commencing such employment the Agency will offer one replacement Candidate free of charge. The Agency shall provide the Client with up to three candidate profiles for free replacement. Such profiles will be selected based on the information originally provided in the Client’s job request and will be provided within two months of notification. The agency accepts no liability and is not obliged to offer a replacement or any refund if the Client finds the Candidates unacceptable and does not want to engage any of the potential Candidates.
10.3 The guarantee does not apply if the Candidate has left the position due to unreasonable working conditions, change of location, change of job description, change of mind, or if Rockmybaby® believes the Candidate has been mistreated in any way.
10.4 A placement is deemed satisfactory after 4 weeks.
10.5 No refunds will be given if a temporary placement has been reduced after the start date.
10.6 Although Rockmybaby® has high expectations of our Candidates, and we aim to provide you with exceptional Candidates, there is still no complete guarantee of reliability, honesty, and character of the Candidate provided by the agency. Any concerns, please contact us immediately.
11.1 By using the Rockmybaby® Agency the Client expressly authorizes Rockmybaby® to collect and publish information about them as detailed in these Terms and Conditions and the Client expressly waive any rights, whether in statute or at common law, to bring any legal action against Rockmybaby® as a result of Rockmybaby® publication of such information, whether the Client considers that information to be fair and accurate or not.
11.2 Rockmybaby® acts as an agent for the Client, not as an employer of the Nanny or Babysitter Candidate. Therefore, the agency accepts no liability or responsibility for accident, injury, loss, damage, or misconduct sustained by Nanny, or Babysitter Candidate, Clients or any other persons. By employing a Nanny or booking a Babysitter through Rockmybaby®, the Client agrees to exclude the agency should any mishap occur.
11.3 Rockmybaby® endeavours to validate the background of our Nannies and Babysitter Candidates and ensure each Candidate is appropriate for its services. However, we cannot guarantee that all the information is correct. Rockmybaby® Agency conducts thorough checks, conducts interviews, reference checks, and ensures the Nanny and Babysitter Candidates hold, or are in the process of obtaining a current Provide First Aid certificate, and a current National Crime Check (NCC) and a current Blue Card/ Working With Children (WWC) Card. It is the decision, and sole responsibility of the Client to engage the Candidate as an employee or independent contractor.
11.4 The Client is responsible for ensuring that their Home Contents Insurance includes cover for Employers and Public Liability insurance for domestic workers, including childcare.
11.5 Rockmybaby® website contains links to third party advertisements and links to third-party sites. Access to any other Internet site linked to the Rockmybaby® website, is at the Client’s own risk. Rockmybaby® accepts no responsibility for the accuracy or reliability of any information, opinions, or statements made in any third-party advertisements or on any third-party sites.
11.6 Any outside users from other countries can access this website – Rockmybaby® makes no representation, the client expressly waives any rights, whether in statute or at common law, to bring any legal action against Rockmybaby® as a result of Rockmybaby® publication of content within this website. The Clients are responsible for ensuring compliance with all laws where they are located.
12.1 Rockmybaby® website uses Payment Express Solutions - our credit card payments are secure certified and compliant to the Payment Card Industry Data Security Standards (PCI DSS), as a level 1 processor; this includes quarterly scans of its systems and annual onsite audits by a Qualified Security Assessor (QSA). DPS PCI compliance validation can be found in VISA's Global List of PCI DSS Validated Service Providers.
12.2 All communication between both parties (Agency & Clients) shall remain confidential.
12.3 Rockmybaby® requires the Client to provide accurate details of their address, contact details and full name.
12.4 Rockmybaby® will release account and other personal information only when the above release is appropriate for the function of the website, to comply with the law; enforcement of our Terms and Conditions; or protect the rights, property, or safety of Rockmybaby® Group, our users, or others. However, the Client authorizes a Rockmybaby® babysitting Candidate to tell a family member or friend where she/he will be, the expected return time, and address of the babysitting booking. This is a simple safety measure for the Babysitter Candidate.

14.1 The Client is not and will not hold themselves out as an agent of Rockmybaby® on any basis.
14.2 No warranty is given for suitability, honesty, capability, and character of any Candidate.
14.3 Rockmybaby® makes no warranties or representations as to the quality, accuracy or completeness of the content on the Rockmybaby® website, or the information otherwise provided by any member.
14.4 The Client is fully responsible for employment and/or contracting arrangements with the Candidate, and all or any legal responsibilities owed by them to the Candidate including, without limitation, any employment obligation or contractual responsibilities.
14.5 The Client will hold Rockmybaby® harmless against any claims arising out of any claims brought against it, arising from the Client’s dealings with and treatment of the Candidate howsoever arising.
14.6 While Rockmybaby® uses reasonable endeavours to ensure that the site is available 24 hours a day, Rockmybaby® does not make any representations or warranties that access will be uninterrupted or error free. Access to the site may be suspended temporarily without notice in the case of system failure, webhosting errors, maintenance or repair, or any reason beyond our control.
15.1 Rockmybaby® prefers to resolve any disputes via mediation – please contact Head office via email at info@rockmybaby.com.au , or call 1800 118 262 with full details.
15.2 Where a dispute arises between the Client/Candidate/Rockmybaby® Agency the Client is to refrain from contacting the Candidate. All communication regards a dispute are to be kept between the Client and Rockmybaby® Agency only.
16.1 All content on Rockmybaby® website – texts, graphics, images, HMTL codes and other material (collectively the “Material”) are protected by New Zealand and international copyright laws and remain the exclusive property of the Rockmybaby® IP Ltd Company.
17.1 The Terms & Conditions shall be governed in accordance with the laws of the state of Australia and users hereby submit to the non-exclusive jurisdiction of the Courts of that state.
17.2 Rockmybaby® website, IP, Copyright is owned and registered by Rockmybaby Group, PO BOX 8720, Havelock North, New Zealand, 4157.

10.2 The Agency fees are non-refundable. Should the Nanny Candidate leave the employment within 4 weeks from commencing such employment the Agency will offer one replacement Candidate free of charge. The Agency shall provide the Client with up to three candidate profiles for free replacement. Such profiles will be selected based on the information originally provided in the Client’s job request and will be provided within two months of notification. The agency accepts no liability and is not obliged to offer a replacement or any refund if the Client finds the Candidates unacceptable and does not want to engage any of the potential Candidates.
10.3 The guarantee does not apply if the Candidate has left the position due to unreasonable working conditions, change of location, change of job description, change of mind, or if Rockmybaby® believes the Candidate has been mistreated in any way.
10.4 A placement is deemed satisfactory after 4 weeks.
10.5 No refunds will be given if a temporary placement has been reduced after the start date.
10.6 Although Rockmybaby® has high expectations of our Candidates, and we aim to provide you with exceptional Candidates, there is still no complete guarantee of reliability, honesty, and character of the Candidate provided by the agency. Any concerns, please contact us immediately.
11.1 By using the Rockmybaby® Agency the Client expressly authorizes Rockmybaby® to collect and publish information about them as detailed in these Terms and Conditions and the Client expressly waive any rights, whether in statute or at common law, to bring any legal action against Rockmybaby® as a result of Rockmybaby® publication of such information, whether the Client considers that information to be fair and accurate or not.
11.2 Rockmybaby® acts as an agent for the Client, not as an employer of the Nanny or Babysitter Candidate. Therefore, the agency accepts no liability or responsibility for accident, injury, loss, damage, or misconduct sustained by Nanny, or Babysitter Candidate, Clients or any other persons. By employing a Nanny or booking a Babysitter through Rockmybaby®, the Client agrees to exclude the agency should any mishap occur.
11.3 Rockmybaby® endeavours to validate the background of our Nannies and Babysitter Candidates and ensure each Candidate is appropriate for its services. However, we cannot guarantee that all the information is correct. Rockmybaby® Agency conducts thorough checks, conducts interviews, reference checks, and ensures the Nanny and Babysitter Candidates hold, or are in the process of obtaining a current Provide First Aid certificate, and a current National Crime Check (NCC) and a current Blue Card/ Working With Children (WWC) Card. It is the decision, and sole responsibility of the Client to engage the Candidate as an employee or independent contractor.
11.4 The Client is responsible for ensuring that their Home Contents Insurance includes cover for Employers and Public Liability insurance for domestic workers, including childcare.
11.5 Rockmybaby® website contains links to third party advertisements and links to third-party sites. Access to any other Internet site linked to the Rockmybaby® website, is at the Client’s own risk. Rockmybaby® accepts no responsibility for the accuracy or reliability of any information, opinions, or statements made in any third-party advertisements or on any third-party sites.
11.6 Any outside users from other countries can access this website – Rockmybaby® makes no representation, the client expressly waives any rights, whether in statute or at common law, to bring any legal action against Rockmybaby® as a result of Rockmybaby® publication of content within this website. The Clients are responsible for ensuring compliance with all laws where they are located.
12.1 Rockmybaby® website uses Payment Express Solutions - our credit card payments are secure certified and compliant to the Payment Card Industry Data Security Standards (PCI DSS), as a level 1 processor; this includes quarterly scans of its systems and annual onsite audits by a Qualified Security Assessor (QSA). DPS PCI compliance validation can be found in VISA's Global List of PCI DSS Validated Service Providers.
12.2 All communication between both parties (Agency & Clients) shall remain confidential.
12.3 Rockmybaby® requires the Client to provide accurate details of their address, contact details and full name.
12.4 Rockmybaby® will release account and other personal information only when the above release is appropriate for the function of the website, to comply with the law; enforcement of our Terms and Conditions; or protect the rights, property, or safety of Rockmybaby® Group, our users, or others. However, the Client authorizes a Rockmybaby® babysitting Candidate to tell a family member or friend where she/he will be, the expected return time, and address of the babysitting booking. This is a simple safety measure for the Babysitter Candidate.

14.1 The Client is not and will not hold themselves out as an agent of Rockmybaby® on any basis.
14.2 No warranty is given for suitability, honesty, capability, and character of any Candidate.
14.3 Rockmybaby® makes no warranties or representations as to the quality, accuracy or completeness of the content on the Rockmybaby® website, or the information otherwise provided by any member.
14.4 The Client is fully responsible for employment and/or contracting arrangements with the Candidate, and all or any legal responsibilities owed by them to the Candidate including, without limitation, any employment obligation or contractual responsibilities.
14.5 The Client will hold Rockmybaby® harmless against any claims arising out of any claims brought against it, arising from the Client’s dealings with and treatment of the Candidate howsoever arising.
14.6 While Rockmybaby® uses reasonable endeavours to ensure that the site is available 24 hours a day, Rockmybaby® does not make any representations or warranties that access will be uninterrupted or error free. Access to the site may be suspended temporarily without notice in the case of system failure, webhosting errors, maintenance or repair, or any reason beyond our control.
15.1 Rockmybaby® prefers to resolve any disputes via mediation – please contact Head office via email at info@rockmybaby.com.au , or call 1800 118 262 with full details.
15.2 Where a dispute arises between the Client/Candidate/Rockmybaby® Agency the Client is to refrain from contacting the Candidate. All communication regards a dispute are to be kept between the Client and Rockmybaby® Agency only.
16.1 All content on Rockmybaby® website – texts, graphics, images, HMTL codes and other material (collectively the “Material”) are protected by New Zealand and international copyright laws and remain the exclusive property of the Rockmybaby® IP Ltd Company.
17.1 The Terms & Conditions shall be governed in accordance with the laws of the state of Australia and users hereby submit to the non-exclusive jurisdiction of the Courts of that state.
