Rockmybaby Australia Terms and Conditions: Candidates

By registering online as a Candidate and agreeing to our Terms & Conditions (via the required tick box), or by accepting any booking or placement, you confirm that you have read, understood, and agree to the following Terms. These Terms are designed to protect Candidates, maintain professionalism, and ensure compliance across Rockmybaby® Australia and its franchise network.

1.0 Contract & Acceptance

1.1 These Terms & Conditions form a legally binding agreement between you ("Candidate") and Rockmybaby® Australia or its authorised franchisee ("Agency"). By ticking the box during registration or accepting a booking, you confirm that you have read, understood, and agree to these Terms & Conditions.

1.2 Completion of registration and/or acceptance of any booking or job constitutes acceptance of these Terms.

1.3 "Client" refers to any individual, family, or employer using Rockmybaby® services.

1.4 "Babysitter" refers to a childcare professional engaged casually or short-term by a Client.

1.5 "Nanny" refers to a childcare professional engaged for ongoing or temporary in-home care (full-time or part-time).

1.6 Providing false, incomplete, or illegal information is prohibited and may be referred to authorities.

1.7 If you do not agree to these Terms, please do not proceed with registration or booking acceptance.

1.8 Candidates must maintain regular communication with Rockmybaby® throughout all stages of placement, including onboarding, job consideration, active bookings, and post-placement feedback. All queries or concerns must be directed to the Agency.

1.9 By registering with Rockmybaby®, you acknowledge that you are acting as an independent contractor, not an employee. You understand and agree that no employment relationship is created between you and Rockmybaby® under any circumstances.

2.0 General Candidate Obligations

2.1 Registration & Vetting
All Candidates must register via the Rockmybaby® Australia website and complete the full onboarding and vetting process. This includes:

  • An online application

  • Personal interview

  • Identity verification (official ID required)

  • At least two verified childcare-related references

  • National Police Check (within 12 months)

  • Valid First Aid Certificate (HLTAID012: Provide First Aid in an Education and Care Setting or equivalent)

  • Valid Working With Children Check (WWCC) or Blue Card (QLD) appropriate to your state/territory

2.2 No Private Arrangements
Candidates must not accept direct work, negotiate private terms, or enter into off-platform arrangements with any Client introduced via Rockmybaby®.
Breach of this policy will result in immediate removal from our network and may result in recovery of agency fees from both parties.

2.3 Responsibility During Bookings
Candidates are responsible for the sole care, supervision, and wellbeing of the children in their care. Children must never be left unattended under any circumstances. Leaving children unsupervised, even briefly, may result in immediate termination and legal consequences depending on the severity.

2.4 Conduct & Professionalism
Candidates must maintain a high level of professionalism, including:

  • Punctuality and clear communication

  • Respecting Client property, privacy, and household rules

  • Leaving the home clean and tidy at the end of a booking

  • Refraining from unnecessary personal phone use during shifts

  • Using the Client's phone only in emergencies

2.5 Child & Client Privacy
Taking, storing, or sharing any photographs, videos, or private information of Clients or their children is strictly prohibited without written parental consent.
This includes any social media activity or messages involving Client content.

2.6 Social Media & Reputation
Rockmybaby® may review a Candidate’s public social media activity during the onboarding process or in response to concerns. Any content deemed inappropriate, discriminatory, or misaligned with our values may result in suspension or termination.

2.7 Right to Refuse & Suspend
Rockmybaby® reserves the right to terminate a Candidate’s registration or suspend access to bookings at any stage if concerns arise relating to behaviour, suitability, reliability, or complaints from Clients.

2.8 Dispute Resolution
In the event of a concern or conflict, the Candidate must not contact the Client directly. All issues must be raised with Rockmybaby® promptly, who will act as the intermediary.

2.9 Confidentiality
All information and communication between Candidates, Clients, and Rockmybaby® must remain confidential and not be shared with any third party.

2.10 Nature of Engagement – Contractor Status

By registering with Rockmybaby® and accepting bookings via the platform, the Candidate acknowledges that they are engaged as an independent contractor, not an employee.

Rockmybaby® is not the employer, nor does it supervise, control, or direct how the Candidate performs their duties. The Candidate is responsible for managing their own: Australian Business Number (ABN), Income tax obligations, Superannuation (if applicable), Insurance and legal compliance, No employment relationship exists between Rockmybaby® and the Candidate, and nothing in these Terms or the booking process creates such a relationship.

2.11 Tax & Contractor Obligations
Babysitters and nannies engaged via Rockmybaby® are independent contractors, not employees.
You are responsible for:

  • Holding an active Australian Business Number (ABN)

  • Managing your own tax, superannuation, and insurance

  • Understanding your legal obligations as a sole trader
    Failure to provide an ABN may result in Rockmybaby® withholding 47% of your payment, as required by the ATO. Visit ato.gov.au for more info.

2.12 Health & Safety Responsibilities
Candidates must take reasonable care for their own health and safety, and that of the children in their care.
You agree to:

  • Follow safe work practices and hygiene procedures

  • Notify Rockmybaby® and/or the Client immediately of any illness, injury, or hazard

  • Report any unsafe working conditions or incidents during a booking

  • Refrain from accepting bookings if you are unwell or unable to provide safe care

2.13 Respect for Clients & Property
Candidates must respect the property, routines, and privacy of all Clients. Any breach of trust, damage, or inappropriate behaviour may result in removal from our platform.

2.14 Termination of Candidate Access
Rockmybaby® reserves the right to remove any Candidate from its network without notice due to:

  • Client complaints

  • Breach of confidentiality

  • Repeated lateness or unreliability

  • Safety or conduct concerns

  • Misuse of the platform or attempting to work off-platform

Misuse of the Rockmybaby® platform or client contact details — including unsolicited messages, off-platform communication, or harassment — is prohibited and will result in removal from the agency network.

2.15 Rockmybaby® may periodically review Candidate performance, reliability, punctuality, communication, and Client feedback. Access to future bookings or placements may be restricted or suspended if a Candidate fails to meet Rockmybaby®'s expected standards of conduct and care

3.0 Babysitter Candidate Obligations

3.1 Babysitters must contact the Client within 24 hours of accepting a booking, or immediately if the request is last-minute or urgent. Clear communication is essential.

3.2 All babysitting bookings have a minimum duration of 3 hours, and hourly rates are fixed by region. Current rates are available on the Rockmybaby® website.

3.3 Babysitters must arrive on time (preferably a few minutes early) and maintain a professional attitude throughout the booking. If you're delayed or unable to attend, you must notify both Rockmybaby® and the Client immediately.

3.4 Repeated no-shows, late cancellations, or unprofessional conduct may result in suspension or permanent removal from the Rockmybaby® platform.

3.5 Babysitters are required to log their completed hours in the Rockmybaby® dashboard after each booking. The Client will then confirm the hours. Failure to confirm hours may delay payment.

3.6 Once hours are confirmed by the Client, payment will be processed by Rockmybaby® and appear in the babysitter's wallet within their dashboard. Funds are then on-forwarded to your nominated bank account. Rockmybaby® acts as a payment facilitator only — no commissions are deducted from your hourly rate.

4.0 Safety & Professional Boundaries

  • 4.1 Candidate safety is a top priority. If you feel unsafe or uncomfortable at any time during a booking, please contact Rockmybaby® immediately so we can support you.

  • 4.2 We strongly recommend that you save Rockmybaby®'s contact numbers (1800 118 262) and notify a trusted friend or family member of your booking details, including the location, expected return time, and who you are working for.

  • 4.3 If you experience inappropriate behaviour, unsafe working conditions, or any breaches of professional boundaries, you must notify Rockmybaby® immediately.

  • 4.4 Child Protection & Mandatory Reporting - Candidates must be aware of and comply with child protection laws relevant to their state or territory. Where required, you must report any suspected child abuse, neglect, or exploitation to the appropriate authorities and inform Rockmybaby® immediately. Failure to do so may result in removal from our platform.

5.0 Babysitter Booking Cancellations

  • 5.1 We understand that plans can change. If you need to cancel a babysitting booking, please let Rockmybaby® know at least 72 hours in advance so we have time to find a replacement.

  • 5.2 If something urgent arises and you need to cancel within 24 hours of the booking, please call both Rockmybaby® and the Client directly as a courtesy.

  • 5.3 Once you’ve accepted a booking, honoring that commitment is important. Reliability is a big part of what makes our team so valued by families.

  • 5.4 Frequent cancellations or failure to follow the cancellation process may affect your standing with the agency or lead to suspension.

6.0 Nanny Placement Terms

  • 6.1 If you're being considered for a nanny role, please keep Rockmybaby® in the loop. Let us know about any planned interviews, communications with the Client, or if you've been offered the job.

  • 6.2 If you find out that you've been referred to the same nanny position by another agency, please let Rockmybaby® know straight away. It helps us manage the process fairly and professionally.

  • 6.2.1 Dual Representation Disclosure - To maintain transparency and avoid conflict of interest, Candidates must inform Rockmybaby® if they are actively working with or being represented by another agency for the same or similar roles. Failure to disclose this may impact eligibility for placements and continued access to our services.

  • 6.3 As a nanny placed through Rockmybaby®, you may be covered under our Public & Statutory Liability insurance. This does not include incidents related to driving or use of the Client’s vehicle, so please ensure you’re covered under the Client’s insurance if driving is required.

  • 6.4 Trial Periods: If you are placed on a trial basis, this will be treated as a temporary nanny booking and Rockmybaby® must be informed. Trial placements do not exclude you from full placement obligations if ongoing work results.

8.0 Liability

8.1 By registering as a Candidate and using the Rockmybaby® platform or accepting any booking, you acknowledge and agree that Rockmybaby® may collect, store, and share relevant information about your profile, history, and suitability for roles as required for placement and safety purposes. You waive any right to bring legal action against Rockmybaby® in relation to the publication, sharing, or use of such information, whether you consider it fair, accurate, or not.

8.2 Rockmybaby® acts as an introduction and booking agent only. We are not the employer of any babysitter, nanny, maternity nurse, or other Candidate. As such, Rockmybaby® is not liable for any accident, injury, misconduct, or loss that may arise during or following a placement. By accepting work through Rockmybaby®, you agree to release the Agency from any claims or liability in connection with your engagement by Clients.

8.3 Clients are responsible for providing a safe working environment, but Rockmybaby® accepts no responsibility for conditions at the Client's premises.

8.4 While we take reasonable steps to vet and match Candidates and Clients, Rockmybaby® cannot guarantee the ongoing conduct or character of either party and is not liable for any dispute that may arise between Candidates and Clients.

8.5 Rockmybaby® is not responsible for the content of third-party websites linked through our platform. Accessing external links, resources, or advertisements is done at the Candidate’s own risk.

8.6 This website may be accessed internationally. It is the Candidate’s responsibility to ensure compliance with the laws and requirements in their own jurisdiction. Australian law governs these Terms and Conditions.

9.0 Confidentiality & Privacy

9.1 All communication between the Candidate and Rockmybaby® is confidential and must not be shared with third parties without prior written consent, except where required by law.

9.2 Candidates must provide and maintain accurate and up-to-date personal information, including their full legal name, residential address, contact details, and emergency contact information.

9.3 Rockmybaby® will only release personal or account information when it is:

  • Required to facilitate or manage bookings;

  • Necessary to comply with Australian law or government authorities;

  • Required to enforce these Terms & Conditions;

  • Needed to protect the rights, property, or safety of Rockmybaby®, its users, or the public.

9.4 For safety, Babysitter Candidates are encouraged to inform a trusted friend or family member of the booking location, the name of the Client, and the expected return time.

9.5 All Candidate information collected during registration and vetting (e.g., ID, references, qualifications, WWCC, Police Checks) is stored securely and handled in accordance with Australian privacy laws.

9.6 Candidate information may be shared with Clients solely for the purposes of assessing suitability for bookings. By registering, you consent to Rockmybaby® sharing your profile details with prospective Clients.

9.7 Rockmybaby® may use the information you provide to:

  • Verify your identity and qualifications;

  • Conduct appropriate vetting, background, and reference checks;

  • Deliver support services and communicate with you;

  • Improve agency services and candidate support.

9.8 For full details, please refer to our Privacy Policy, which outlines how we collect, store, and use your personal information in accordance with the Privacy Act 1988 (Cth).

9.9 By registering, you consent to receive communication from Rockmybaby® via email, SMS, phone, and platform notifications for the purposes of service delivery, updates, and account management. You can opt out of non-essential messages at any time.

10.0 Warranties & Indemnities

10.1 The Candidate acknowledges that they are not an employee, representative, or agent of Rockmybaby® and must not present themselves as such in any capacity.

10.2 The Candidate understands that all placements made via Rockmybaby® are between the Client and the Candidate directly. Rockmybaby® acts solely as an introducer and facilitator of services.

10.3 Rockmybaby® makes no guarantees regarding the accuracy, reliability, completeness, or suitability of any information provided via the website or by any third party, including Clients.

10.4 The Candidate is solely responsible for:

  • Ensuring they comply with all applicable employment, tax, and legal obligations as an independent contractor;

  • Negotiating the terms of any temporary or ongoing engagements directly with the Client;

  • Maintaining up-to-date insurance, superannuation, and tax registrations, including a valid ABN.

10.5 The Candidate agrees to indemnify Rockmybaby®, its directors, and agents from any claims, losses, damages, liabilities, or expenses arising from or in connection with:

  • Any dispute between the Candidate and the Client;

  • Any breach of these Terms;

  • Any failure to meet legal obligations as an independent contractor;

  • Any action or conduct by the Candidate while performing work introduced by Rockmybaby®.

10.6 While Rockmybaby® makes reasonable efforts to ensure uninterrupted access to its online platform, the Candidate acknowledges that temporary outages may occur due to maintenance, technical issues, or events beyond the Agency’s control. No liability is accepted for any downtime or disruptions.

10.7 Any falsification or misrepresentation of qualifications, references, identity, or experience during registration, onboarding, or while on assignment is grounds for immediate termination and may be reported to appropriate authorities.

10.8 Client Feedback Use - Feedback or reviews provided by Clients may be used internally by Rockmybaby® for performance monitoring, training, service quality improvement, or resolving disputes. By registering with Rockmybaby®, you consent to this use.

10.9 10.9 Rockmybaby® shall not be liable for any failure or delay in performance of obligations due to events beyond its reasonable control, including but not limited to natural disasters, system outages, strikes, or government restrictions.

11.0 Dispute Resolution

11.1 Rockmybaby® encourages open communication and aims to resolve disputes promptly and professionally via internal mediation. To report a concern, please contact us.

11.2 In the event of a dispute between the Candidate and the Client, the Candidate agrees not to contact the Client directly. All communication must go through Rockmybaby® for resolution. This ensures objectivity, safety, and confidentiality for all parties.

12.0 Copyright & Trademarks

12.1 All website content, including text, design, graphics, images, logos, HTML, and data, is the intellectual property of Rockmybaby® IP Ltd and protected under Australian and international copyright laws.

12.2 No part of the website may be reproduced, copied, modified, or republished without express written consent from Rockmybaby® Group.

13.0 Governing Law

13.1 These Terms & Conditions are governed by the laws of the Commonwealth of Australia. By registering with Rockmybaby®, you submit to the non-exclusive jurisdiction of Australian courts for any disputes or claims arising from these Terms.

13.2 Rockmybaby® IP, trademarks, and copyrights are owned and registered by Rockmybaby Group, PO BOX 8720, Havelock North, New Zealand, 4157.

13.3 Rockmybaby® reserves the right to update or amend these Terms at any time. Continued use of our platform constitutes acceptance of any changes. Continued use of the Rockmybaby® platform or acceptance of new bookings after updated Terms are published constitutes acceptance of the new version.
