Rockmybaby Sydney Terms and Conditions: Casual Babysitter employees

By agreeing to these Terms & Conditions (via the required tick box), or by accepting any booking or placement, you confirm that you have read, understood, and agree to the following Terms. These Terms are designed to protect employees, maintain professionalism, and ensure compliance across Rockmybaby® Sydney and the Rockmybaby® Australia franchise network.
1.0 Contract & Acceptance
1.1 These Terms & Conditions apply to casual babysitters at all times while you are undertaking casual employment with Rockmybaby® Sydney or its authorised franchisee ("Agency"). By ticking the box during registration or accepting a booking, you confirm that you have read, understood, and agree to these Terms & Conditions. While you must comply with these Terms & Conditions, they do not form part of your employment agreement and are not binding on the Company.
1.2 Acceptance of a booking or engagement constitutes acceptance of these Terms.
1.3 "Client" refers to any individual, family, or employer using Rockmybaby® services.
1.4 "Babysitter/ Babysitters" refers to a childcare professional engaged in a casual employment relationship by Rockmybaby® Sydney.
1.5 Providing false, incomplete, or illegal information is prohibited and may be referred to authorities.
1.6 If you do not agree to these Terms, please do not proceed with registration, or with any bookings or engagements from Rockmybaby® Australia or its Agency.
1.7 Babysitters must maintain regular communication with Rockmybaby® Sydney throughout all stages of their placement or their engagement, including (where relevant) onboarding, job consideration, active bookings, and post-placement feedback. All queries or concerns must be directed to the Agency.
2.0 General Obligations for Casual Babysitters:
2.1 Registration & Vetting
As set out in your Casual Employment Contract, all Babysitters will undergo full onboarding and vetting, including that they hold the appropriate certifications, pass the required Police Check and hold a valid WWCC as part of their pre-employment vetting process.
2.2 No Private Arrangements
Babysitters must not accept direct work, negotiate private terms, or enter into off-platform arrangements with any Client introduced via Rockmybaby®. Breach of this policy will result in immediate removal from our network and may result in recovery of agency fees from both parties.
2.3 Responsibility During Bookings
Babysitters are responsible for the sole care, supervision, and wellbeing of the children in their care. Children must never be left unattended under any circumstances. Leaving children unsupervised, even briefly, may result in immediate termination of a Babysitters casual engagement with the Agency.
2.4 Conduct & Professionalism
Babysitters must maintain a high level of professionalism, including:
• Punctuality and clear communication
• Respecting Client property, privacy, and household rules
• Leaving the home clean and tidy at the end of a booking
• Refraining from unnecessary personal phone use during shifts
• Using the Client's phone only in emergencies
2.5 Child & Client Privacy
Taking, storing, or sharing any photographs, videos, or private information of Clients or their children is strictly prohibited without written parental consent. This includes any social media activity or messages involving Client content.
2.6 Social Media & Reputation
Rockmybaby® may review Babysitters public social media activity during a babysitters casual employment with the Agency in response to concerns. Any content deemed inappropriate, discriminatory, or inconsistent with the duties and responsibilities of a Babysitter may result in the Babysitter not being offered any further engagements by the Agency, which may include terminating their access to the platform.
2.7 Health & Safety Responsibilities
Babysitters must take reasonable care for their own health and safety, and that of the children in their care. You agree to:
• Follow safe work practices and hygiene procedures
• Notify Rockmybaby® and/or the Client immediately of any illness, injury, or hazard
• Report any unsafe working conditions or incidents during a booking
• Refrain from accepting bookings if you are unwell or unable to provide safe care
2.8 Respect for Clients & Property
You must respect the property, routines, and privacy of all Clients. Any breach of trust, damage, or inappropriate behaviour may result in removal from our platform.
2.10 Rockmybaby® may periodically review Babysitters performance, reliability, punctuality, communication, and Client feedback.
3.0 Your Obligations when engaged as a Babysitter
3.1 Babysitters must contact the Client within 24 hours of accepting a casual engagement, or immediately if the request is last-minute or urgent. Clear communication is essential.
3.2 All babysitting bookings have a minimum duration of 3 hours, and your hourly rates is as set out in your casual employment agreement.
3.3 Babysitters must arrive on time (preferably a few minutes early) and maintain a professional attitude throughout the booking. If you're delayed or unable to attend, you must notify both Rockmybaby® and the Client immediately.
3.4 Repeated no-shows, late cancellations, or unprofessional conduct may result in you not being offered any further casual engagements by the Agency or your permanent removal from the Rockmybaby® platform.
3.5 Babysitters are required to log their completed hours in the Rockmybaby® dashboard after each booking. The Client will then confirm the hours. Failure to confirm hours may delay payment.
4.0 Safety & Professional Boundaries for Babysitters
4.1 Your safety is a top priority for Rockmybaby®. If you feel unsafe or uncomfortable at any time during a booking, please contact Rockmybaby® immediately so we can support you.
4.2 Please ensure that you save Rockmybaby Sydney®'s contact number (1800 603 697) and contact us if you have any concerns.
4.3 If you experience inappropriate behaviour, unsafe working conditions, or any breaches of professional boundaries, you must notify Rockmybaby® immediately.
4.4 Child Protection & Mandatory Reporting - You must be aware of and comply with child protection laws relevant to your state or territory. Where required, you must report any suspected child abuse, neglect, or exploitation to the appropriate authorities and inform Rockmybaby® immediately. Failure to do so may result in the Agency not offering you any further casual engagements.
5.0 Babysitter Booking Cancellations
5.1 We understand that plans can change. If you need to cancel a babysitting booking, please let Rockmybaby® know at least 72 hours in advance, so we have time to find a replacement.
5.2 If something urgent arises and you need to cancel within 24 hours of the booking, please call both Rockmybaby® and the Client directly as a courtesy.
5.3 Once you’ve accepted a booking, honouring that commitment is important. Reliability is a big part of what makes our team so valued by families.
5.4 Frequent cancellations or failure to follow the cancellation process may may result in the Agency not offering you any further casual engagements.
6.0 Liability
6.1 Babysitters accept that by using the Rockmybaby® platform or accepting any booking, they acknowledge and agree that Rockmybaby® may collect, store, and share relevant information about their profile, history, and suitability for roles as required for placement and safety purposes. Babysitters waive any right to bring legal action against Rockmybaby® in relation to the publication, sharing, or use of such information.
6.2 Clients are responsible for providing a safe working environment, but Rockmybaby® accepts no responsibility for conditions at the Client's premises. If you have any safety concerns regarding the conditions at the Client’s premises please advise the Agency immediately.
6.3 While we take reasonable steps to vet and match Babysitters with Clients, Rockmybaby® is not liable for any dispute that may arise between Babysitters and Clients.
6.4 Rockmybaby® is not responsible for the content of third-party websites linked through our platform. Accessing external links, resources, or advertisements is done at your own risk.
7.0 Confidentiality & Privacy
7.1 All communication between Babysitters and Rockmybaby® is confidential and must not be shared with third parties without prior written consent, except where required by law.
7.2 For safety, when you have accepted a casual engagement as a babysitter you are also encouraged to inform a trusted friend or family member of the booking location, the name of the Client, and the expected return time.
7.3 Limited information about Babysitters (for example, your experience, name, age and contact number) may be shared with Clients solely for the purposes of assessing suitability for bookings.
7.4 Rockmybaby® may use the information you provide to:
• Verify your identity and qualifications;
• Conduct appropriate vetting, background, and reference checks;
• Deliver support services and communicate with you;
• Improve agency services and support.
7.5 By entering into a casual employment contract as a Babysitter, you consent to receive communication from Rockmybaby® via email, SMS, phone, and platform notifications for the purposes of service delivery, updates, and account management. You can opt out of non-essential messages at any time.
8.0 Client feedback use
8.1 Client Feedback Use - Feedback or reviews provided by Clients may be used internally by Rockmybaby® Sydney for performance monitoring, training, service quality improvement, or resolving disputes. By accepting a casual engagement with Rockmybaby® Sydney, Babysitters consent to this use.
9.0 Dispute Resolution
9.1 Rockmybaby® encourages open communication and aims to resolve disputes promptly and professionally via internal mediation. To report a concern, please contact us.
9.2 In the event of a dispute between you and the Client, you agree not to contact the Client directly. All communication must go through Rockmybaby® Sydney for resolution. This ensures objectivity, safety, and confidentiality for all parties.
10.0 Copyright & Trademarks
10.1 All website content, including text, design, graphics, images, logos, HTML, and data, is the intellectual property of Rockmybaby® IP Ltd and protected under Australian and international copyright laws.
10.2 No part of the website may be reproduced, copied, modified, or republished without express written consent from Rockmybaby® Group.
11.0 Governing Law
11.1 These Terms & Conditions are governed by the laws of the Commonwealth of Australia. The non-exclusive jurisdiction of Australian courts apply for any disputes or claims arising from these Terms.
11.2 Rockmybaby® IP, trademarks, and copyrights are owned and registered by Rockmybaby Group, PO BOX 8720, Havelock North, New Zealand, 4157.
11.3 Rockmybaby® reserves the right to update or amend these Terms at any time. Continued use of our platform constitutes acceptance of any changes. Continued use of the Rockmybaby® platform or acceptance of new bookings after updated Terms are published constitutes acceptance of the new version..
