Rockmybaby Sydney Terms and Conditions: Nannies

By registering online with Rockmybaby® Sydney and agreeing to these Terms & Conditions (via the required tick box), or by accepting any booking or placement, you confirm that you have read, understood, and agree to the following Terms. These Terms are designed to protect Candidates, maintain professionalism, and ensure compliance across Rockmybaby® Sydney, and the Australia and the Rockmybaby® Australia franchise network. 1.0 Contract & Acceptance 1.1 These Terms & Conditions apply to Nannies at all times while you are utilising the Rockmybaby® platform or the platform of its authorised franchisee Rockmybaby® Sydney ("Agency"). By ticking the box during registration or accepting a booking, you confirm that you have read, understood, and agree to these Terms & Conditions. 1.2 Acceptance of a booking constitutes acceptance of these Terms. 1.3 "Client" refers to any individual, family, or employer using Rockmybaby® services. 1.4 "Nanny/ Nannies" refers to a childcare professional engaged for ongoing or temporary in-home care (full-time or part-time), including a Maternity Nurse directly by the Client, which is facilitated through the Rockmybaby® Sydney platform. 1.5 Providing false, incomplete, or illegal information is prohibited and may be referred to authorities. 1.6 If you do not agree to these Terms, please do not proceed with registration, or with any bookings or engagements from Rockmybaby® Australia or its Agency. 1.7 Nannies must maintain regular communication with Rockmybaby® Sydney throughout all stages of their placement, including (where relevant) onboarding, job consideration, active bookings, and post-placement feedback. All queries or concerns must be directed to the Agency. 1.8 By registering with Rockmybaby Sydney ®, you acknowledge that you are not an employee of Rockmybaby Sydney®, and any relationship that you have either as an independent contractor or employee will be directly with the Client. You understand and agree that no employment relationship is created between you and Rockmybaby® under any circumstances.
2.0 General Obligations for both Nannies 2.1 Registration & Vetting All Nanny Candidates must register via the Rockmybaby® Australia website and complete the full onboarding and vetting process. This includes:
• An online application
• Personal interview
• Identity verification (official ID required)
• At least two verified childcare-related references
• National Police Check (within 12 months)
• Valid First Aid Certificate (HLTAID012: Provide First Aid in an Education and Care Setting or equivalent)
• Valid Working with Children Check (WWCC).
2.2 No Private Arrangements Nannies must not accept direct work, negotiate private terms, or enter into off-platform arrangements with any Client introduced via Rockmybaby®. Breach of this policy will result in immediate removal from our network and may result in recovery of agency fees from both parties. 2.3 Responsibility During Bookings Nannies are responsible for the sole care, supervision, and wellbeing of the children in their care. Children must never be left unattended under any circumstances. Leaving children unsupervised, even briefly, may result in a Nanny being removed from the platform. 2.4 Conduct & Professionalism Nannies must maintain a high level of professionalism, including:
• Punctuality and clear communication
• Respecting Client property, privacy, and household rules
• Leaving the home clean and tidy at the end of a booking
• Refraining from unnecessary personal phone use during shifts
• Using the Client's phone only in emergencies 2.5 Child & Client Privacy Taking, storing, or sharing any photographs, videos, or private information of Clients or their children is strictly prohibited without written parental consent. This includes any social media activity or messages involving Client content.
2.6 Social Media & Reputation Rockmybaby® may review Nannies public social media activity during the onboarding process for Nannies in response to concerns. Any content deemed inappropriate, discriminatory, or inconsistent with the duties and responsibilities of a Nanny may result in the Nanny having their access to the platform removed.
2.7 Right to Refuse & Suspend If concerns arise from Clients regarding your behaviour, suitability, reliability or other concerns, subject to the seriousness of the concern raised, Rockmybaby® may suspend access to the platform, or terminate your registration on the platform. 2.8 Dispute Resolution In the event of a concern or conflict, Nannies must not contact the Client directly. All issues must be raised with Rockmybaby® promptly, who will act as the intermediary. 2.9 Confidentiality All information and communication between Nannies, Clients, and Rockmybaby® must remain confidential and not be shared with any third party. 2.10 Nature of Engagement – By registering with Rockmybaby® and accepting Nanny positions via the platform, you acknowledge that you are not an employee of Rockmybaby® Sydney, but will be engaged directly by the Client. Rockmybaby® Sydney is not the employer, nor does it supervise, control, or direct how you will perform your duties as a Nanny. Rockmybaby® Sydney solely acts as a referral service for short term and long term services to be provided directly from the Nanny to the client.
No employment relationship exists between Rockmybaby® and the Nanny, and nothing in these Terms or the booking process creates such a relationship. Payment to the Nanny will occur directly from the Client to the Nanny without the involvement or input of Rockmybaby® Sydney. 2.12 Health & Safety Responsibilities Nannies must take reasonable care for their own health and safety, and that of the children in their care. You agree to:
• Follow safe work practices and hygiene procedures
• Notify Rockmybaby® and/or the Client immediately of any illness, injury, or hazard
• Report any unsafe working conditions or incidents during a booking
• Refrain from accepting bookings if you are unwell or unable to provide safe care 2.13 Respect for Clients & Property You must respect the property, routines, and privacy of all Clients. Any breach of trust, damage, or inappropriate behaviour may result in removal from our platform. 2.14 Termination of access to platform for Nannies As set out in clauses 2.7 and 2.8 above, Rockmybaby Sydney® may remove access for Nannies from the platform and the network due to:
• Clients complaints
• Breach of confidentiality
• Repeated lateness or unreliability
• Safety or conduct concerns
• Misuse of the platform or attempting to work off-platform Misuse of the Rockmybaby® platform or client contact details — including unsolicited messages, off-platform communication, or harassment — is prohibited and will result in Nannies being removed from the agency network. 3.0 Nanny Placement Terms
• 3.1 If you're being considered for a nanny role, to be engaged either on a casual, fixed term or permanent basis by a Client, please keep Rockmybaby® in the loop. Let us know about any planned interviews, communications with the Client, or if you've been offered the job.
• 3.2 If you find out that you've been referred to the same nanny position by another agency, please let Rockmybaby® know straight away. It helps us manage the process fairly and professionally.
• 3.2.1 Dual Representation Disclosure - To maintain transparency and avoid conflict of interest, Nannies must inform Rockmybaby®. if they are actively working with or being represented by another agency for the same or similar roles. Failure to disclose this may impact eligibility for placements and continued access to our services.
• 3.3 As a Nanny whose relationship is directly with the Client, please ensure you are covered under the Client’s insurance if you are driving is required and you are driving the Client’s vehicle.
• 3.4 Trial Periods: If you are placed on a trial basis, this will be treated as a temporary nanny booking and Rockmybaby® must be informed. Trial placements do not exclude you from full placement obligations if ongoing work results. 4.0 Liability 4.1 Nannies accept that by using the Rockmybaby® platform or accepting any booking, they acknowledge and agree that Rockmybaby® may collect, store, and share relevant information about their profile, history, and suitability for roles as required for placement and safety purposes. Nannies waive any right to bring legal action against Rockmybaby® in relation to the publication, sharing, or use of such information. 4.2 Rockmybaby® acts as an introduction and booking agent only for Nannies. We are not the employer of any Nannies. As such, Rockmybaby® is not liable for any accident, injury, misconduct, or loss that may arise during or following a direct engagement with a Client as a Nanny. By accepting work through Rockmybaby®, you agree to release the Agency from any claims or liability in connection with your engagement by Clients as a Nanny. 4.3 Clients are responsible for providing a safe working environment, but Rockmybaby® accepts no responsibility for conditions at the Client's premises. If you have any safety concerns regarding the conditions at the Client’s premises please advise the Agency immediately.
4.4 While we take reasonable steps to vet and match You with Clients, Rockmybaby® is not liable for any dispute that may arise between Nannies and Clients. 4.5 Rockmybaby® is not responsible for the content of third-party websites linked through our platform. Accessing external links, resources, or advertisements is done at your own risk. 4.6 This website may be accessed internationally. Australian law governs these Terms and Conditions. 5.0 Confidentiality & Privacy 5.1 All communication between Nannies and Rockmybaby® is confidential and must not be shared with third parties without prior written consent, except where required by law. 5.2 Nannies must provide and maintain accurate and up-to-date personal information, including their full legal name, residential address, contact details, and emergency contact information. 5.3 Rockmybaby® will only release personal or account information in accordance with the relevant legislation and in accordance with the casual employment contract. 5.4 For safety, when you have accepted an engagement with a Client, you are also encouraged to inform a trusted friend or family member of the booking location, the name of the Client, and the expected return time. 5.5 All information collected during registration and vetting (e.g., ID, references, qualifications, WWCC, Police Checks) is stored securely and handled in accordance with Australian privacy laws. 5.6 Rockmybaby® may use the information you provide to:
• Verify your identity and qualifications;
• Conduct appropriate vetting, background, and reference checks;
• Deliver support services and communicate with you;
• Improve agency services and support. 5.7 For full details, please refer to our Privacy Policy, which outlines how we collect, store, and use your personal information in accordance with the Privacy Act 1988 (Cth). 5.8 By registering as a Nanny, you consent to receive communication from Rockmybaby® via email, SMS, phone, and platform notifications for the purposes of service delivery, updates, and account management. You can opt out of non-essential messages at any time.
6.0 Warranties & Indemnities 6.1 Nannies acknowledge that they are not an employee, representative, or agent of Rockmybaby® and must not present themselves as such in any capacity. 6.2 Nannies understand that all placements made via Rockmybaby® are between the Client and the Candidate directly. Rockmybaby® acts solely as an introducer and facilitator of services. 6.3 Rockmybaby® makes no guarantees regarding the accuracy, reliability, completeness, or suitability of any information provided via the website or by any third party, including Clients. 6.4 Nannies are solely responsible for:
• Ensuring they comply with all applicable employment, tax, and legal obligations If they are engaged by the client as an independent contractor and not engaged as an employee by the family;
• Negotiating the terms of any temporary or ongoing engagements directly with the Client;
• Maintaining up-to-date insurance, superannuation, and tax registrations, including a valid ABN. 6.5 Nannies agrees to indemnify Rockmybaby®, its directors, and agents from any claims, losses, damages, liabilities, or expenses arising from or in connection with:
• Any dispute between the Nanny and the Client;
• Any breach of these Terms;
• Any failure to meet legal obligations as an independent contractor;
• Any action or conduct by the Nanny while performing work introduced by Rockmybaby®. 6.6 While Rockmybaby® makes reasonable efforts to ensure uninterrupted access to its online platform, Nannies acknowledge that temporary outages may occur due to maintenance, technical issues, or events beyond the Agency’s control. No liability is accepted for any downtime or disruptions. 6.7 Any falsification or misrepresentation of qualifications, references, identity, or experience during registration, onboarding, or while on assignment is grounds for immediate termination of your registration on the platform and may be reported to appropriate authorities.
6.8 Client Feedback Use - Feedback or reviews provided by Clients may be used internally by Rockmybaby® Sydney for performance monitoring, training, service quality improvement, or resolving disputes. By registering with Rockmybaby® Sydney, Nannies consent to this use. 6.9 Rockmybaby® Sydney shall not be liable for any failure or delay in performance of obligations due to events beyond its reasonable control, including but not limited to natural disasters, system outages, strikes, or government restrictions. 7.0 Dispute Resolution 7.1 Rockmybaby® encourages open communication and aims to resolve disputes promptly and professionally via internal mediation. To report a concern, please contact us. 7.2 In the event of a dispute between you and the Client, you agree not to contact the Client directly. All communication must go through Rockmybaby® Sydney for resolution. This ensures objectivity, safety, and confidentiality for all parties. 8.0 Copyright & Trademarks 8.1 All website content, including text, design, graphics, images, logos, HTML, and data, is the intellectual property of Rockmybaby® IP Ltd and protected under Australian and international copyright laws. 8.2 No part of the website may be reproduced, copied, modified, or republished without express written consent from Rockmybaby® Group. 9.0 Governing Law 9.1 These Terms & Conditions are governed by the laws of the Commonwealth of Australia. The non-exclusive jurisdiction of Australian courts apply for any disputes or claims arising from these Terms. 9.2 Rockmybaby® IP, trademarks, and copyrights are owned and registered by Rockmybaby Group, PO BOX 8720, Havelock North, New Zealand, 4157. 9.3 Rockmybaby® reserves the right to update or amend these Terms at any time. Continued use of our platform constitutes acceptance of any changes.
